VAN DAILY EXCESS POLICY
INTRODUCTION
The information in this policy wording contains important information and we have made it as easy as possible to understand. Please take time to read through it and contact us if you need any further information.

INSURER
Benefits under this policy are provided by AXA Travel Insurance Limited and underwritten by Inter Partner Assistance S.A, IFSRA registration number NL161, with its registered address at 10-11 Mary Street, Dublin 1, Ireland. Inter Partner Assistance is a branch of Inter Partner Assistance S.A., Avenue Louise 166 bte1, 1050 Brussels, a Belgian company authorised by the Banking, Finance and Insurance Commission of Belgium, registration 0487. All are member companies of the Global AXA Group.

Inter Partner Assistance, Irish Branch is regulated in the Republic of Ireland by the Irish Financial Services Regulatory Authority.

STATEMENT OF PRICE
Provides Excess cover for UK hires only, for an inclusive premium of £7.99 per day for the specified period up to 180 continuous days for any one van rental agreement.

Already included within this Policy's inclusive daily cost there is an Administration Fee of £3.76 and any applicable Insurance Premium Tax at 5%.

WHO IS ELIGIBLE TO PURCHASE THIS INSURANCE?
Any person: -
 Aged between 21 and 84
 Holding a valid or internationally recognised driving licence
 Eligible to rent and drive the vehicle and able to adhere to the terms of the car hire agreement

WHAT MAKES UP THIS POLICY?
This policy and the certificate of insurance must be read together as they form your insurance contract.

WHAT ARE YOU COVERED FOR?
This insurance is designed to cover you for loss or damage to any vehicle that you rent under a rental agreement that occurs during the period of insurance. This insurance also covers you for baggage as shown further in this document.

MONETARY LIMITS
We can insure you up to the amount of the sum insured or other specified limit, which will be shown in this policy.

COOLING OFF PERIOD
Your policy contains a “cooling-off” period of 14 days. If you find this policy does not meet with your needs, email, telephone or write to Insuremyvanhire.com, 3rd Floor, 40 Mitre Street, London, EC3A 5BZ, email address: info@insurance4carhire.com, telephone number: (+ 44 (0) 844 892 1770) within 14 days. Your policy must be cancelled prior to the commencement date and your premium will be refunded as long as you have not rented a vehicle and do not intend to make a claim.

JURISDICTION AND LAW
This insurance shall be governed by the laws of England, whose courts alone shall have jurisdiction in any dispute arising from this insurance.

When you contact AXA Assistance , you will need to say that you are insured with Inter Partner Assistance through Insuremyvanhire.com and give the following information: -

 Your name
 Your address
 A telephone number that you can be contacted on
 Your master policy and certificate number shown on your Certificate of Insurance.

CLAIMS NOTIFICATION
In the event of loss please contact AXA Assistance within 31 days of incurred loss to notify loss and request a claim form to be sent to you by email, fax or post. Alternatively, a claim form can be downloaded from our website. Please fully complete, sign and date the claim form and return it with all supporting documentation: -
 Copy of your Certificate of Insurance
 Copy of Rental Contract
 A copy of your Charge Receipt (if separate from the Rental Agreement)
 A copy of the Law Enforcement / Police Report (if applicable) for Damage
 Renter's copy of the rental company's accident damage report.
 Invoices / Receipts / other documents confirming the amount you have paid in respect of Accident / Damage / Loss etc. for which the Vehicle Rental Company holds you responsible.
 Copy of your credit card statement showing payment of the damages claimed
 Copy of the driving licence of the person involved in the accident (the driver)
 Name and address of your bank together with the sort code and account details. This will facilitate payment, as the insurance company prefers to make the payment directly to your bank.

Failure to provide this information may result in your claim being delayed. If a claim is made or suit is brought against the named insured, the named insured shall immediately forward to the Company every demand, notice, summons or other process received by him /her or his/her representative.

WAR AND TERRORISM EXCLUSION
 Notwithstanding any provision to the contrary within this insurance or any endorsement thereto it is agreed that this insurance excludes loss, damage, cost or expenses of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other consequence to the loss: -

 War, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power;

 Or any act of terrorism.

 For the purpose of this endorsement an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

 This endorsement also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to (1) and/or (2) above.

 If the underwriters allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance the burden of proving the contrary shall be upon the Assured.

 In the event any portion of this endorsement is found to be invalid or unenforceable, the reminder shall remain in full force and effect.

GENERAL CONDITIONS APPLICABLE TO THE WHOLE POLICY
1. Persons who have not paid in full the appropriate or additional premium.
2. Wilfully self-inflicted injuries or illnesses, alcoholism or the use of alcohol or drugs (other than drugs taken in accordance with treatment prescribed and directed by a registered medical practitioner, but not for the treatment of drug addiction) self-exposure or needless peril (except in an attempt to save human life).
3. Loss or destruction of or damage to any property whatsoever, or any liability, loss or exposure whatsoever resulting or arising there from or any consequential loss directly or indirectly caused by or contributed to by or arising from (a) ionising radiation or contamination by radioactivity from any nuclear fuel or any waste and the combustion of nuclear fuel or (b) the radioactive toxic explosive or other hazardous properties or any explosive nuclear assembly or nuclear component thereof.
4. Loss or damage directly or indirectly occasioned by happening through or in consequence of war, terrorism, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation or nationalisation or requisition or destruction of or damage to property by or under the order of any government or public or local authority.
5. Losses in respect of any property or expenses more specifically insured or any claim which but for the existence of this insurance should be recoverable under any other insurance.
6. Claims or incidents that may give rise to a claim not notified directly in writing to the Claims Office within 31 days of the expiry of the Insurance.
7. Any fraudulent, dishonest or criminal act committed by the Insured Person or anyone with whom they are in collusion, or insurance effected in circumstances where a claim might reasonably be anticipated;
8. Loss arising from operation of the vehicle in violation of the terms of the Rental Agreement.
9. Expenses assumed, waived or paid by the Rental Agency or its Insurers.
10. Automobiles or other vehicles, which are not Rental Vehicles.
11. Wear and tear, gradual deterioration, insect or vermin, inherent vice or damage.
12. Transporting contraband or illegal trade.
13. Driving by persons who are not named on the Rental Agreement.
14. The rental of "Expensive or Exotic" vehicles not considered to be a conventional and usual rental vehicle, and “Antique” vehicles, which are over 20 years old or which have not been manufactured for 10 years or more. Any vehicle with a Retail Purchase Price in excess of GBP 80,000 will not be insured unless specifically agreed by the underwriters (minimum of 4 working days) prior to rental.
15. The rental of certain vehicles, namely: motor homes, trailers or caravans, motorcycles, mopeds, motorbikes, off-road vehicles, recreational vehicles, and vehicles with more than 9 seats, or as agreed by special acceptance from underwriters. Expenses reimbursed by the Insured Person's Employers' Insurer.
16. No coverage provided for those aged less than 21 years and over 84 years of age.
17. Losses occurring from driving whilst not on a Public Highway.
18. Coverage must coincide with the rental agreement; coverage will be voided if the coverage either for the insurance policy or the rental agreement does not coincide. No policy can be issued retroactively.
19. Trucks, commercial vehicles and vans with more than an unloaded weight of 3.5 Metric Tonnes.

GENERAL CONDITIONS IN ADDITION TO THOSE SHOWN ELSEWHERE IN THIS POLICY
1. The due observance and fulfilment of all the terms and conditions of this insurance by you or anyone acting on your behalf.
2. Written notice of accidents, proceedings or any other events, which may give rise to a claim, shall be given to the Claims Office in writing within 31 days. All Certificates, information and evidence required by the Claims Office shall be furnished at the expense of the Insured Person or their legal representatives.
3. Except with our written consent, you or your representative(s) are not entitled to admit liability on our behalf or to give any representations or other undertakings binding upon us. We shall be entitled to the absolute conduct, control and settlement of all proceedings arising out of or in connection with claims in your name.
4. We may at our own expense take proceedings in your name to recover compensation from any third party in respect of any indemnity provided under this Insurance and any amounts recovered shall belong us. You agree to render all reasonable assistance to us to recover such amounts.
5. No rental agreement longer than 180 continuous days for Daily Policies;

WARRANTY
This insurance is provided for one rental vehicle at any one time, which may be driven and operated by you. Cover will take effect from the time you take legal control of the rental vehicle and will cease at the time the rental company assumes control of the rental vehicle whether at its business location or elsewhere.
This policy must have been purchased prior to the commencement of a rental agreement for which you wish this policy to be operative.

DEFINITIONS APPLYING TO SECTION 1
1. "Rental Company" means a company or agency who are fully licensed with the regulatory authority of the country, state or local authority where the Rental Vehicle is collected.
2. " Rental Agreement" means the contract signed by the Lead named driver (who must be the name on the Insurance Certificate as issued) that states the excess to which the lead named driver is responsible, who must also be the Policyholder.
3. ”Trip" means any rental Vehicle, which is collected and rented from a Licensed Rental Company or Agency.
4. “UK” means England, Wales, Scotland, Northern Ireland, Channel Islands and the Isle of Man.
5. “You, your” means the person(s) named on the rental agreement and included on the certificate of insurance as named drivers and which attaches to this policy. The lead person on the certificate of insurance must also be the lead person named on the car rental agreement.
6. “We, us, our” means The Insurer of the insurance policy.

COMPENSATION SCHEME
The Financial Services Compensation Scheme covers Insuremyvanhire.com. You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 100% of the first £2,000 and 90% of the remainder of the claim, without any upper limit. Further information about compensation scheme arrangements is available from the FSCS (www.fscs.org.uk).

SECTION 1 – EXCESS REIMBURSEMENT

WHAT YOU ARE COVERED FOR
This Section covers You for any physical loss or damage to the Rental Vehicle for which you are responsible for under the terms of the Rental Agreement. You are covered for physical damage (including damage to windscreens, tyres, the under body and roof), fire, theft, vandalism related thereto or loss of use of the Rental Vehicle.

SUM INSURED
You have purchased UK cover where the sum insured is £2,000 any single incident or £3,000 for a series of incidents during any single car rental agreement.


TERMS OF BUSINESS

1. DISCLOSURE INFORMATION & TERMS OF BUSINESS ("TERMS")
In these Terms references to “we” or “us” are to the company whose details are set out in the covering letter or email that accompanies these Terms. We recommend that you carefully read these Terms that will apply to our appointment by you and the services that we will provide.

2. WHO ARE WE REGULATED BY?
The Financial Services Authority (“FSA”) is the independent watchdog that regulates financial services. Insurmyvanhire.com is a trading name of Towergate Underwriting Group Limited, which is authorised and regulated by the FSA and you can check this by visiting the FSA’s website http://www.fsa.gov.uk/register or by contacting the FSA on 0845 606 1234.

Permitted Business: Our permitted activities are arranging insurance cover; dealing as agent and assisting with the administration and performance of policies – all in connection with general insurance. You will not receive advice or a recommendation from us. We may ask you questions to narrow down the selection of products that we will provide details on. You will then need to make you own choice about how to proceed.

3. ARE WE COVERED BY THE FINANCIAL SERVICES COMPENSATION SCHEME (“FSCS”)?
We are covered by the Financial Services Compensation Scheme (FSCS). If we are unable to meet our obligations, you may be entitled to compensation from the scheme, depending on the type of insurance and the circumstances of the claim. Further information is available from the FSCS at www.fscs.org.uk

For compulsory classes of insurance, insurance advising and arranging is covered for 100% of any claim, without upper limit.

4. COMPLAINTS
Our objective is to provide a high standard of service to you at all times. However we recognise that things can go wrong occasionally and if this occurs we are committed to resolving matters promptly and fairly. If you wish to register a complaint please contact us:

 By email or mail, to the Managing Director at the address shown in the Complaints Procedure of the policy above;
 By telephone, using the number shown in the Complaints Procedure section 14 of the policy above.

In all cases please quote your policy number. If you cannot settle your complaint with us you may be entitled to refer it to the Financial Ombudsman Service.

5. WHICH INSURANCE COMPANIES DO WE USE TO SELECT YOUR INSURANCE?
For the type of insurance for which you have been quoted, we will use AXA

6. OUR SERVICE
We are an insurance intermediary acting on your behalf as your agent in arranging your insurance cover. Our service may include, arranging insurance cover with insurers to meet your requirements, issuing policy documentation to you in a timely manner and helping you with any ongoing changes you wish to make to your insurance.

7. THE FEES WE CHARGE FOR OUR SERVICES
Insurance companies and other third parties pay us commission for arranging your insurance with or through them. We will also usually charge a fee for our services (typically when you buy or renew a policy) but you will always be informed of any such charge before you purchase a policy.

CREDIT CARD FEES
When purchasing a policy with a credit card we levy a fee. This fee is displayed on the payment screen once you select the type of card you wish to use. The amount charged depends on the cost of your policy. The fees are as follows:

Daily - All policies
- £1.00 total per daily policy

Annual - All policies
- £00.00 to £49.00 = £1.50
- £50.00 to £99.00 = £2.00
- £100.00 plus = £3.00

This amount is added to the cost of the policy and will be charged as a total sum on your card, and as one transaction on your credit card statement.

This charge can be avoided if you pay with a Debit card.

8. REFUND OF PREMIUMS
In certain circumstances your insurer may repay part of your insurance premium(s) to us. This can occur where, for example, the policy is cancelled. This paragraph does not affect any cancellation/refund rights which retail customers may have pursuant to paragraph 10 below

9. YOUR LEGAL DUTY TO DISCLOSE INFORMATION TO US AND INSURANCE COMPANIES
It is your responsibility to provide complete and accurate information to insurers when you take out your insurance policy, throughout the life of the policy and when you renew it. It is important you ensure that all statements you make or confirm during the course of requesting a quote and/or purchasing an insurance policy through our website, together with statements made in any claims forms, and other documentation are full and accurate. Please note that if you fail to disclose any material information or change of circumstances to your insurers, this could invalidate your insurance cover and could mean that part or all of a claim may not be paid. We strongly recommend that the information provided is checked thoroughly prior to submission and that you keep a record of all correspondence supplied in relation to the arrangement of your insurance cover. Please also note that any renewal of insurance will be made in reliance upon the information provided by you in connection with your previous insurance policy – we will assume that such information remains correct unless you tell us otherwise.

10. CANCELLATION RIGHTS
You are entitled to cancel this policy at any time your cancellation rights are set out in the Cooling Off Period section 10 and Cancellation section 11 of the policy.

11. INFORMATION ON OUR REMUNERATION
In addition to commission which is paid to us by insurers we may earn management or administrative fees and other payments from insurers for efficiently managing business transacted with them. These payments may be calculated by reference to various criteria such as overall annual profitability of the insurance business transacted, taking into account the total amount of claims arising under policies we place with them.

During the course of our appointment we may hold certain monies on your behalf. This may include premiums to be paid to insurers, commissions derived from your insurance, claims monies and other sums. Interest and investment returns which are derived from such sums whilst temporarily held on your or your insurer’s behalf will belong to and be retained by us in addition to any other remuneration which we may earn in connection with the services which you have asked us to perform.

For each insurance contract, including any subsequent renewal, you have a right to request information regarding any remuneration that we may have received as a result of placing your insurance business

12. INSURER SOLVENCY
Whilst Insuremyvanhire.com will endeavour to place business with insurers who demonstrate an adequate level of financial solvency, and although their regulator requires them to maintain a minimum level of capital, they cannot guarantee the solvency of any insurer.

13. HOW TO MAKE A CLAIM
If you wish to report a claim or potential claim, please contact AXA Assist. Please quote your policy number. Your Policy Document (above) provides details as to how to make a claim and whom to contact.

14. YOUR INSURANCE POLICY(IES)
As and when we feel it appropriate we may review your policy and look to enhance and/or extend the cover offered.

15. TERMS OF PAYMENT
Our payment terms are as follows:

 new policies – full payment of premium including fees at time of purchasing the policy on our website
 renewals – full payment of premium including fees at time of renewing policy.

We accept payment by debit or credit card.

The acceptance by us of any payment from you does not constitute acceptance of any risk by insurers or any commitment by us to arrange insurance cover on your behalf. Accordingly you should not assume that insurance cover is in place until you have received email confirmation of cover in the form of a policy document, policy certificate or equivalent.

16. IMPORTANT INFORMATION RELATING TO RENEWAL OF POLICIES
Prior to the expiry of your policy where we will be inviting a renewal we will endeavour to send you details of the cost and terms to renew your policy.

17. HOW WE HOLD YOUR MONEY
AXA Assist have agreed to deem any premiums that you pay to us as having been received directly by themselves. This improves your protection against financial loss in the event of our insolvency.

18. CONFIDENTIALITY AND DATA PROTECTION
All information about you of a sensitive or personal nature will be treated as private and confidential. We will however use and disclose the information we have about you in the course of arranging, placing and administering your insurance. This may involve passing information about you to insurers, other intermediaries and other third parties involved (directly or indirectly) in your insurance

We may also pass information about you to other companies which are in or are associated with our group. We or they may also use the information we hold about you to provide you with information on other products and services we or they can offer and which we or they feel may be of interest to you. If you do not wish to receive marketing information from us or them, please contact us immediately.

In the interests of security and to improve our service, telephone calls you make to us may be monitored and/or recorded.

19. NO WAIVER AND AMENDMENTS
A failure at any time by us to enforce any right or obligation shall not be deemed to be a continuing waiver of such right or obligation. No amendment or variation of these Terms requested by you shall be valid unless confirmed in writing by our duly authorised officer or employee. We reserve the right to amend these Terms at any time during our appointment (including for the avoidance of doubt during the term of your insurance) by giving you not less than 7 days’ notice. We may freely assign or delegate all or any part of these Terms and/or the services to any third party.

20. PRIOR AGREEMENTS AND ACCEPTANCE
These Terms supersede all proposals, prior discussions and representations (whether oral or written) between us relating to our appointment as your agent in connection with the arranging and administration of your insurance. These Terms constitute an offer by us to act on your behalf in the arranging and administration of your insurance – in the absence of any specific acceptance communicated to us by you (whether verbal or written) you are deemed to accept our offer to act for you on the basis of these Terms by conduct upon your instructing us to arrange, renew or otherwise act for you in connection with insurance matters.

21. GOVERNING LAW
These Terms are governed by and construed in accordance with the Laws of England and Wales and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.
